Terms of Service

Effective date: November 1, 2026

PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE AN ASSUMPTION OF RISK (SECTION 6), A DISCLAIMER OF WARRANTIES (SECTION 13), A LIMITATION OF LIABILITY (SECTION 14), A RELEASE OF CLAIMS (SECTION 15), AND AN INDEMNITY (SECTION 16) THAT AFFECT YOUR LEGAL RIGHTS. SECTION 19 EXPLAINS HOW DISPUTES ARE RESOLVED.

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Tribesence LLC, a Delaware limited liability company ("Tribesence," "we," "us," or "our"). They govern your use of the Tribesence website at tribesence.com, any Tribesence app, and the features, content, and communications we provide through them (together, the "Service").

By creating an account, by checking a box or clicking a button that refers to these Terms, or by otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy, available at tribesence.com/privacy.html, which explains how we handle your information. If you do not agree, do not use the Service.

2. What Tribesence is — and what it is not

Tribesence is an information and planning platform. You tell us about your group, such as its size, age ranges, interests, budget, timing, and how far you are willing to travel, and we suggest group experiences, curate itineraries, and surface information about venues, trails, restaurants, events, and other destinations operated by independent third parties. The Service currently focuses on experiences in the San Francisco Bay Area.

We do not own, operate, control, inspect, supervise, staff, insure, or endorse any venue, trail, business, event, or activity that appears on the Service. We are not a tour operator, travel agency, guide service, event organizer, or transportation provider. We do not accompany you, supervise any gathering, or verify the condition or safety of any location. Unless we expressly state otherwise for a particular feature, we do not sell tickets, make reservations, or process payments for any third-party experience.

Any experience you choose to attend is a matter between you and the third parties involved. You decide whether to go, where to go, and what to do when you arrive.

3. Eligibility and age requirements

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you meet this age requirement and that the information in your account is accurate.

Many venues, events, and activities surfaced by the Service have their own age restrictions, including locations that serve alcohol and admit only persons 21 or older. Age limits are set and enforced by the venue, not by Tribesence. We may label an experience as age-restricted, but any such label is informational and may be incomplete, outdated, or wrong. You are responsible for confirming that every member of your group meets the age and entry requirements of any location before you go.

You may not use the Service to arrange, encourage, or facilitate the attendance of anyone below a venue's minimum age, or to help any person obtain alcohol or any other age-restricted product or service unlawfully.

4. Your account

You must provide accurate information when you create an account and keep it up to date. You are responsible for keeping your password confidential and for all activity under your account. Use a strong password that you do not use for other services, and notify us promptly at connect@tribesence.com if you believe someone has accessed your account without your permission.

Your account is personal to you. You may not share, sell, or transfer it to anyone else.

You may delete your account at any time from your Profile page. Deletion is permanent. Our Privacy Policy describes what happens to your information when you delete your account.

5. Information on the Service may be inaccurate, incomplete, or out of date

Content on the Service — including hours of operation, opening and closing times, pricing and cost estimates, menus, addresses, admission policies, age restrictions, accessibility details, trail conditions, difficulty ratings, distances, routes, travel times, availability, and reviews — is compiled from publicly available sources, third-party data providers, venue-supplied information, and automated systems. We do not independently verify it.

We make no representation or warranty that any such information is accurate, current, or complete. Venues close permanently or temporarily, change hours, change policies, reach capacity, require reservations, or restrict entry without notice. Trails close, flood, burn, ice over, or become impassable.

Automated and AI-generated content. Recommendations, itineraries, descriptions, routes, distances, and travel-time and cost estimates on the Service are generated or assisted by automated tools, including artificial intelligence and mapping services. Automated content can be wrong, incomplete, or out of date, and it can describe a place, feature, route, or detail that does not exist or no longer applies. Treat every suggestion as a starting point, not as a verified fact.

Before you travel to any location, confirm directly with the venue or the responsible authority that it is open, that it will admit your group, and that conditions are suitable. Do not rely on the Service as your sole source of information for any decision.

6. Assumption of risk

You understand that real-world activities carry inherent risks that cannot be eliminated. These include, without limitation: traveling to and from a location, including by car and on road trips; hiking, walking on uneven or unmarked terrain, and other outdoor recreation; exposure to weather, wildlife, water, altitude, and natural hazards; getting lost; physical exertion; the consumption of food and alcohol; the condition of third-party premises; the acts and omissions of venue operators, staff, other patrons, and other members of your group; crime; and accident or illness, including serious injury and death.

YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH ANY EXPERIENCE, ACTIVITY, VENUE, OR LOCATION YOU CHOOSE TO ATTEND, WHETHER OR NOT IT WAS SUGGESTED TO YOU BY THE SERVICE, AND WHETHER OR NOT THOSE RISKS ARE FORESEEABLE. You are solely responsible for assessing your own fitness, ability, equipment, preparation, and judgment, and that of anyone attending with you.

Nothing on the Service is medical, safety, legal, or other professional advice. If anyone in your group has health, dietary, accessibility, or other needs, confirm directly with the venue that it can meet them before you go.

7. Interactions with other people

If the Service introduces you to other users, lets you share plans, or helps coordinate gatherings, you should know that we do not conduct background checks on users unless we expressly state otherwise, and we make no representation about any user's identity, character, or conduct.

You are solely responsible for your interactions with other users and with third parties. Exercise the same caution you would when meeting anyone you do not know. Meet in public places, tell someone where you are going, and leave any situation that feels unsafe.

You are responsible for sharing the relevant plan details, venue requirements, and safety information with the people who attend an experience with you.

8. Your groups, plans, and information about others

When you describe your group, you may enter information such as age ranges, group type, interests, budget, starting ZIP code, and notes. Enter only information you have the right to share. Do not include other people's names, contact details, or health information unless it is genuinely needed to plan the outing and they would expect you to share it. Group details and notes are processed by our service providers, including artificial-intelligence providers, as described in our Privacy Policy.

If you use a feature that lets you share a plan, such as a share link or QR code, anyone who receives the link may be able to view the shared plan. Share links with care.

9. Your responsibilities and acceptable use

You agree to: comply with all applicable laws and with the rules, policies, and age requirements of every location you visit; respect posted closures, trail markings, permit requirements, and the instructions of staff and authorities; provide accurate account information; not use the Service to harass, endanger, defraud, or discriminate against anyone; and not scrape, copy, resell, or redistribute content from the Service except as we permit in writing.

You also agree not to:

10. Your content and feedback

You keep ownership of the content you submit to the Service, such as group names, preferences, notes, and survey responses ("Your Content"). You grant Tribesence a non-exclusive, worldwide, royalty-free license to host, store, copy, process, and display Your Content, and to share it with our service providers, solely to operate, provide, secure, and improve the Service. This license ends when Your Content is deleted from the Service, except for copies we are permitted to keep under our Privacy Policy.

If you send us ideas, suggestions, or feedback, we may use them without restriction and without any obligation to you.

11. Our intellectual property

The Service, including its design, text, graphics, itineraries, software, and the Tribesence name and logo, is owned by Tribesence or its licensors and is protected by intellectual property laws to the extent those laws apply. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service and to download, print, and share itineraries for your own non-commercial use. All rights not expressly granted are reserved.

12. Third-party content, links, and services

The Service contains content, names, marks, images, and links belonging to third parties. Their inclusion is not an endorsement by or affiliation with Tribesence. Your use of any third-party site or service is governed by that party's own terms.

Some features use Google Maps to calculate distances and routes or to open a route in Google Maps. Your use of those features is subject to the then-current Google Maps/Google Earth Additional Terms of Service at https://maps.google.com/help/terms_maps.html and the Google Privacy Policy at https://www.google.com/policies/privacy/.

13. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY RECOMMENDATION WILL SUIT YOUR NEEDS.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRIBESENCE AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT, IF ANY, YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, willful injury, gross negligence, or violation of law.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

15. Release

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE TRIBESENCE AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS FROM ALL CLAIMS, DEMANDS, AND DAMAGES, KNOWN OR UNKNOWN, ARISING OUT OF OR CONNECTED WITH ANY EXPERIENCE, VENUE, ACTIVITY, LOCATION, OR THIRD PARTY YOU ENCOUNTER THROUGH THE SERVICE, AND FROM ANY DISPUTE BETWEEN YOU AND ANOTHER USER OR A THIRD PARTY, INCLUDING CLAIMS ARISING FROM OUR ORDINARY NEGLIGENCE. THIS RELEASE DOES NOT EXTEND TO ANY LIABILITY THAT CANNOT LAWFULLY BE RELEASED, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL INJURY, FRAUD, OR VIOLATION OF LAW.

In giving this release, you expressly waive the protection of California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You also waive any similar protection under the law of any other jurisdiction, to the extent it applies.

16. Indemnity

You agree to indemnify and hold harmless Tribesence and its officers, directors, members, employees, and agents from claims brought by third parties, and from the resulting losses and expenses (including reasonable legal fees), to the extent arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, (c) Your Content, or (d) your conduct at any location you visit. We will notify you of any such claim. We may choose to control the defense at our own expense, and if we do, you agree to cooperate with us.

17. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms. If we make material changes, we will notify you through the Service or by email at least 14 days before the changes take effect and update the effective date above. Other changes, such as clarifications or changes required by law, take effect when posted. Changes will not apply to any dispute that arose before they took effect. Continued use after the effective date means you accept the revised Terms. If you do not agree to them, stop using the Service and delete your account.

18. Suspension and termination

We may suspend or terminate your access at any time, including for conduct that endangers others or breaches these Terms. You may stop using the Service at any time, and you may delete your account as described in Section 4. Sections 5, 6, 10, 11, and 13 through 20, and any other provision that by its nature should survive, survive termination.

19. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Informal resolution first. Before filing a claim, you and Tribesence each agree to try to resolve the dispute informally. Send a written description of the dispute and the relief you are seeking to connect@tribesence.com; we will send ours to the email address on your account. If the dispute is not resolved within 30 days after the notice is received, either party may proceed as described below.

Courts. Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be decided exclusively by the state or federal courts located in the State of California, and you and Tribesence consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in small claims court if the claim qualifies.

Nothing in this section prevents either party from seeking urgent injunctive relief to stop unauthorized use or misuse of the Service, or limits any right you have under California law that cannot be waived by contract.

20. General terms

Entire agreement. These Terms, together with any additional terms we present for a specific feature, are the entire agreement between you and Tribesence regarding the Service. Our Privacy Policy explains how we handle your information.

Severability. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will stay in full effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or part of our business.

Electronic communications. You agree that we may send you notices, disclosures, and other communications electronically, including by email and through the Service, and that these communications satisfy any legal requirement that they be in writing.

Events beyond our control. We are not responsible for any delay or failure to perform caused by events beyond our reasonable control.

Headings. Section headings are for convenience only and do not affect how these Terms are interpreted.
